overtreding verlopig rijbwijs

Bericht door Omar »

Hi,
I have (L) driving licence [verlopig rijbwijs - 18 months.] "I followed the 20 hours at driving school"
This means I can drive alone or with a passenger with 8 years driving licence.
The police cough me when I was with a passenger who has not a driving licence.
Th police take all info from me, no fines were charged immediately.

Does somebody know the situation now?
How much do I have to pay as a fine? When I have to pay it?
Is there any dramatic consequences, such as take my driving licence for ever?

Looking forward for any comments.
Thanks in advance.

I would advise you to get a good lawyer. I'm afraid, you 'l get summoned before the police court.

normally minimum 300 euro, maximum 3.000 euro, but a part of it can be conditionally
+ 150 euro contribution for Trust Fund of Victims
+ court costs.

wettelijke basis:

Artikel 30

§ 2. Met geldboete van 50 euro tot 500 euro, wordt gestraft hij die :

1° een overtreding heeft begaan van de bepalingen door de Koning vastgesteld krachtens artikel 23 §1, 2° en 4°, hetzij als bestuurder, hetzij als persoon die een bestuurder begeleidt met het oog op de scholing;

Is there any dramatic consequences, such as take my driving licence for ever ?
No.

Thanks for you reply.
However, I forgot to mention an issue that the passenger with me has a valid international driving licence, which was not with him when the Police cough us.
Do you think it can help my situation.

I'm afraid I don't understand it anymore.

Sorry for non-clarity.

Indeed, my friend, who was in the car with me, is not Belgian (like me).
In our country, it is possible to issue an international driving licence with the validity of 6 Months. The holder of this international driving licence can drive anywhere in the world. It is possible also to drive in Belgium using this international driving licence.

When the Police cough us, the international driving licence was not with my friend. He left it at home. Moreover, we forgot to inform the police about this issue.

I did not tell this story in the first message, because my friend has just informed me (two hours ago) that he has this kind of driving licenses.

My question is: do you think this issue can support me?

I hope it is clear for you now.
Regards

While your friend can drive around in Belgium with this international licence, it's not sufficient to accompany someone who's learning to drive.

Only persons who can obtain a Belgian driver's licence, can legally accompany you while driving with a temporary learner's permit.

Essentially, it means they must live here, must be registered in the populace records:
- having permanent residence here
- be here in a diplomatic / consular function
- be here for over 6 months for educational reasons

Artikel 3

a) de identiteitskaart van Belg of voor vreemdeling;
b) het bewijs van inschrijving in het vreemdelingenregister;
c) de bijlage 7bis, de bijlage 8, de bijlage 8bis, de bijlage 9 of de bijlage 9bis bij het koninklijk besluit van 8 oktober 1981 betreffende de toegang tot het grondgebied, het verblijf, de vestiging en de verwijdering van vreemdelingen;
d) het attest van immatriculatie;

2° de personen die het bewijs leveren van hun inschrijving in een Belgische onderwijsinstelling gedurende een periode van ten minste zes maanden en die houder zijn van het geldige verblijfsdocument bedoeld in bijlage 33 van het koninklijk besluit van 8 oktober 1981 betreffende de toegang tot het grondgebied, het verblijf, de vestiging en de verwijdering van vreemdelingen;

3° de personen die houder zijn van een van de volgende in België afgegeven geldige documenten :
a) de diplomatieke identiteitskaart;
b) de consulaire identiteitskaart;

It's largely irrelevant if he had it with him or left it at home.

If he requires an International driver's licence to drive around in Belgium, it means he can't accompany you anyway .

Theoretically, he could also be prosecuted for illegally accompanying you, but apparently that doesn't happen very often.
My question is: do you think this issue can support me?
Hardly, but DO get a copy of his International driver's licence while you can.

If it goes to court, which may take up to a year , you can use anything in your defence.
